Federal judge scolds Oregon drug kingpin, spares him from life in prison
A Portland judge scolded the kingpin of a Mexican drug gang on Monday for damaging the lives of Americans from coast to coast as he ran methamphetamine superlabs, trafficked in cocaine and orchestrated vast marijuana plantations.

Thankfully the defendent only received a verbal scolding and not a sternly worded letter...

Ortiz-Oliva, whose principal operation was in Salem, presided over one of the biggest drug operations ever uncovered in Oregon. He ran a small, armed empire of distributors with connections to the Nocupetaro drug cartel in Mexico, according to Assistant U.S. Attorney Kathleen Bickers.

Some of the Ortiz-Oliva gang's meth labs could produce up to 30 pounds at a time, causing a massive supply of the highly addictive drug at a time when Oregon's social service agencies were scarcely prepared for its ravages, Bickers said. The gang moved drugs across the nation.

The most important victims here are Oregon's social service agencies. Can you imagine what they were going through? No, you can't. That's because you have a productive job.

Authorities had to keep going back to judges for permission to tap his new phones, allowing the Mexican citizen to use the U.S. Constitution to stay one step ahead of the law, Bickers told the court.

Judge Brown ruled that Ortiz-Oliva was a career criminal, based on earlier convictions for a Salem shooting that left a man with a wounded hand; possessing meth with the intent to distribute the drug; and beating his girlfriend as she held one of their children in her arms.

He shot someone... had drugs for sale... and beat his girlfriend. I don't want this guy to go to jail, I want him to live in the same neighborhood as my congressman!

I guess that if you paid zero federal income tax (since they claim to only do low wage jobs) and had various state agencies jumping through hoops to get you welfare then I guess that you would love other people paying taxes as well.

Audit finds thousands of Oregon tax evaders

An audit by the Oregon secretary of state’s office says thousands of Oregon workers get away without paying state taxes because officials don’t do enough to identify them. The audit released Monday faults the state’s main tax collectors for not matching federal tax data with state tax rolls

Let's list some reasons why someone might not pay their state income taxes:

1. They don't have a social security number.
2. They aren't working legally.
3. They have no respect for our laws.

It amazes me that we talk about how many illegal aliens are working in this state and then when an article like this comes around the intrepid reporters don't think to make the connection.

It's another one of those conundrums where you illegal alien supporters can't give a good answer to the question: Do people who aren't working legally file their income taxes?

If the answer is no then we have the above situation. If the answer is yes then the first follow up question is "why" and the second follow up question is "whose social security number did they steal to do it?"

Does anyone think that illegals feel some civic duty to give more of their ill-gotten gains to the state by filing taxes?

A legal discussion

There was a lot of talk yesterday (on Lars Larson) about Sgt. Kyle Nice displaying his weapon during a "road rage" incident.

Here is my take: we are a nation of laws. The police have to follow the same laws that we do. We should be treated the same when it comes to violations of the law.

So here is the law:

163.190 Menacing. (1) A person commits the crime of menacing if by word or conduct the person intentionally attempts to place another person in fear of imminent serious physical injury.

166.190 Pointing firearm at another; courts having jurisdiction over offense. Any person over the age of 12 years who, with or without malice, purposely points or aims any loaded or empty pistol, gun, revolver or other firearm, at or toward any other person within range of the firearm, except in self-defense, shall be fined upon conviction in any sum not less than $10 nor more than $500, or be imprisoned in the county jail not less than 10 days nor more than six months, or both. Justice courts have jurisdiction concurrent with the circuit court of the trial of violations of this section. When any person is charged before a justice court with violation of this section, the court shall, upon motion of the district attorney, at any time before trial, act as a committing magistrate, and if probable cause be established, hold such person to the grand jury.

That's it. Prove intent on the menacing or you have nothing. There is NO LAW regarding brandishing or displaying your firearm. You are free to open carry in this state and you are free to handle your firearm as long as you don't point it at someone or have the intent to cause someone fear of imminent serious physical injury or death.

With that being said, I have no doubt that a non-government employee would have been treated differently in the same situation. Where I differ from the majority of opinions on the radio yesterday is that I'm not arguing for the officer to be punished, I'm arguing that us lowly citizens should be left alone when we don't break the law.

Clackamas jail pioneers system to identify illegal immigrants

Federal immigration authorities activated a new information-sharing system this week at the Clackamas County Jail, making it easier for deputies to identify criminal suspects who are in the country illegally.

The system, developed by the U.S. Departments of Justice and Homeland Security, uses fingerprints, photos and biographical information. It will be extended to other Oregon counties in coming months as part of the U.S. Immigrations and Customs Enforcement Secure Communities initiative.

Since its launch in October 2008, ICE's Secure Communities initiative has identified more than 18,800 aliens nationwide charged with or convicted of Level 1 crimes, such as murder, rape and kidnapping. More than 4,000 of those have been deported.

ICE also has removed more than 25,000 foreign nationals charged with or convicted of Level 2 and 3 crimes, including burglary and property crimes.

I will wait patiently for the outcry from illegal alien apologists who claim that they only want to "keep families together" yet somehow oppose common sense ideas such as weeding out the worst of the worst to make sure that they get deported.

Why don't the groups that push amnesty applaud actions to rid our country of the scumbags who make the rest of the illegal alien population look worse than they already do? They could release a statement saying that "we support the idea of Juan stealing your job and your social security number but the minute he gets a DUI we want him gone!"

While I'm waiting for that statement we can at least rest easier knowing that an illegal alien who gets caught driving drunk will now be deported rather than released to kill American citizens.

Portland School Board To Consider Support For Measure 68

An Oregon measure aimed at making it easier to pay for new school buildings goes before the Portland school board Monday.

Portland district staff have recommended board members support Ballot Measure 68 at their meeting tonight.

But it’ll be up to voters across Oregon to approve or reject the constitutional amendment, in May. 
 
The measure would allow the Oregon legislature to issue bonds to match voter-approved school district construction bonds. The state’s involvement would be new.

It's never enough. I would love to have a reporter ask the public school teacher's "what per pupil funding is enough to do the job." We all know the answer: "how much will you give us."

During this election cycle ask your local candidate "how much is needed." Get a real dollar figure. No one will ever give one because then they wouldn't be able to ask for more.

Researchers from Washington State, Oregon State and Michigan State universities are in the second year of a four-year project to develop a mechanical harvester that could not only save growers money on harvest costs, but also remove stems from the cherries. The stems sometimes dent the fruit as it's shipped.

The U.S. Equal Employment Opportunity Commission (EEOC) announced today that it has resolved its gender-based hiring class lawsuit against Les Schwab Tire Centers of Washington, et al., and Les Schwab Tire Warehouse, Inc. for $2,000,000 and other corrective measures.

"The EEOC will continue to investigate employers and industries that have put women in certain types of jobs, and men in others. We hope Les Schwab becomes a model employer of women in the male-dominated tire industry."

The company is based in Bend, Oregon.

Police act swiftly after gun purchases
Concerns about an Oregon Department of Transportation employee who purchased several guns after being placed on leave prompted law enforcement across Southern Oregon to step in.

ODOT Communications Director Patrick Cooney said there were administrative, personnel matters involved that limited what the department could discuss.

However, the state agency had reported concerns about the man to law enforcement agencies, who started monitoring him, officials said.

Authorities were "extremely concerned" that the man may have been planning to retaliate against his employers, the news release said.

"Instead of being reactive, we took a proactive approach," OSP Sgt. Jeff Proulx said.

Police are holding the weapons for safekeeping, but no criminal charges have been filed.

ODOT: the same agency that wants to put a GPS device in your car. Perhaps this will facilitate the issuing of proactive speeding tickets.

OSP: arresting your for things that you haven't done but that a government worker imagines you could possibly do.

Several lessons should be taken from this. First, buy private. It is clear that the background checks are being used for more than just making sure that you can legally purchase a firearm.

Second, where is the Oregon ACLU? These guys have wild nightmares of an out-of-control government keeping child-porn out of taxpayer funded libraries but can't seem to comment on a citizen being taken from his home in the middle of the night on the whim of government officials?
Third, we aren't paranoid if they really are out to get us.

Eugene City Councilors are set to vote Monday night on a controversial subject: Should undocumented immigrant students be allowed to pay in-state tuition at public universities?

Diego Hernandez, a University of Oregon senior with a double-major in ethnic studies and political science, thinks so.

"If we close the door on them," Hernandez asked, "what are they going to do?"

I think that a majority of Oregonians would respond to that questions by saying: "They will hopefully go home."

Eugene Mayor Kitty Piercy supports the Dream Act. Councilor will vote on a resolution in support of the act Monday night. The vote will not affect the legislation, just show the council's support.

"In this case, we're talking about kids who spent their whole lives going to our public schools and want to have the same opportunities as everyone else," Piercy said.

They don't have the same opportunity because they can't legally have a job. What good is a college degree if you can't work? And aren't these illegal aliens just doing the jobs that Americans don't want to do? Jobs that apparently require a college education.

This is almost funny coming on the heels of the recent protest where spoiled brats whined that school is too expensive for them. I'm guessing that those same people support this idea. I'll let that irony sink in.

U.S. regulators are encouraging public pension funds that control more than $2 trillion to inject capital directly into the banking system by buying failed lenders, said people briefed on the matter.

Oregon’s retirement fund may contribute $100 million as regulators seek “the support of state pension funds to solve the crisis surrounding ongoing bank failures,” Jay Fewel, a senior investment officer at the Oregon State Treasury, said in a presentation made at the fund’s Feb. 24 meeting.

Government is investing money for political reasons and trying to pick winners and losers. They get to play with money like it isn't theirs. Oh wait, it isn't.

Supreme Court Weighs Chicago's Strict Gun Ban
In 1982, Chicago imposed the strict gun ordinance to help combat rampant gang and firearm violence that plagued the city.

In court papers, lawyers for the city of Chicago pointed out that 402 of the 412 firearm homicides occurred with the use of handguns in 2008.

I believe that pretty much EVERYONE should be able to have guns. I'm in favor of high school kids storing guns in their locker when on the rifle team. That being said, I don't think that the city of Chicago lawyers should have guns because they are clearly so stupid that they would only be a danger to themselves and others.

They banned handguns and then argue that since so many handguns were used in murders the ban should stay in effect...

Court Hears Second Amendment Debate On City Ban
Paul McGrath was an aide to Mayor Byrne who helped craft the city's anti-gun legislation. He believes doing away with the gun restrictions would be a bad idea.

"If our gun control law is struck down, there will be more guns," McGrath said. "Do we want more guns?"

Yes, we want more guns. In fact, I can't think of a good limit on the number of guns that I would like to purchase. Heck, just in the category of shotguns I can think of at least 5 more that I really really need. But I guess that before I exercise my God-given and constitutionally protected right I should check with Mr. McGrath to see if he thinks that it is a "bad idea."

Clearly our rights should be subject to the "bad idea" test on a regular basis.

State and local gun laws are in the cross hairs as the Supreme Court prepares for a historic oral argument Tuesday.

The conservative majority that struck down Washington, D.C.'s handgun ban in 2008 appears poised to stretch the Second Amendment further. The session Tuesday will let justices test-fire arguments in a case in which the reasoning could be as intriguing as the outcome.

For gun owners and lawmakers, McDonald v. City of Chicago presents one bottom line: If the court agrees that the Second Amendment covers state and local governments, as seems likely, some but not all gun restrictions will be blown away.

Blown away... I don't get it...

For constitutional scholars, the court's means may be as important as its ends. To eliminate Chicago's gun ban, court conservatives could end up overturning a 137-year-old precedent that has hindered the expansion of new rights.

Let me explain to Seattle Times writer Michael Doyle a very simple truth. We have a right to keep and bear arms. This is not a "new" right. This is a natural right that our constitution prevents government from infringing upon.

In my world this means:

Background checks = government has no business doing them.

Issuing "licenses" to carry concealed = government has no business doing them.

Restricting capacity, style or cyclic rate of fire = government has no business doing it.

If you want a good example about how the unconstitutional NFA (national firearms act) is the dumbest thing ever:

This firearm has a fake suppressor to keep the barrel over 16" in length because it is a rifle due to it's buttstock.


This is the EXACT SAME FIREARM but since it it has the buttstock removed it is considered a pistol and does not need to be 16" in length.

Now you can purchase an SBR (short barrel rifle) as long as you tithe the government with $200 or if you are better than the rest of us and you work for government you can possess these weapons in your official capacity as "better than citizens."

I really had thought that we had reached a point where unemployment benefits would be extended forever. When"it's for the children" trumps the constitution and how do we pay for it is a consideration for another generation it is refreshing to see Jim Bunning demanding to know where the money is to extend unemployment benefits. (a term that I despise, there should be no "benefit" to being unemployed)

Senate Bill 1080 mandates that the Department of Transportation require proof of legal presence in the United States and, in most cases, a verified Social Security number prior to issuance, renewal or replacement of driver licenses, driver permits, or identification cards.

Most clearly affected are undocumented Mexican immigrants, who are estimated to account for 56% of the Mexican-born population in the U.S. There is reason to believe that the proportion of undocumented Mexicans is even higher in Oregon, as it is a "new destination" for Mexican migration, and appears to be receiving a relatively high number of migrants from "new sending states" in Mexico, such as Oaxaca.

The research problem to be addressed is to investigate... the degree to which immigrants may be driving less, and thereby losing better employment, housing, health care, educational, social and cultural opportunities,

Total project cost is $95,000. Project duration is 12 months.

Why would we spend $95K to see if illegal aliens are having trouble getting to their cultural opportunities? Or for that matter, getting to better employment which they can't legally have. Do any of Oregon's unemployed wonder why ODOT is so worried about illegals getting to their jobs?

Annual sessions measure advances
Since statehood, Oregon’s legislators have journeyed on an every-other-year schedule to the Capitol to write laws and approve budgets.

Senate President Peter Courtney, the Legislature’s biggest cheerleader for annual sessions, said he thinks the need for lawmakers to come to Salem every year has reached critical mass.

“The affairs of state have become too complex for the Legislature to address by meeting for a few months every other year,” the Salem Democrat told the Senate Rules Committee before it voted on the constitutional amendment.

While state agencies, lobbyists and ballot-measure campaigns have acquired more clout in influencing public policy, the Legislature has not, Coutney said, adding that the Legislature “is no longer a co-equal branch of government.”

Courtney's claim that "affairs of state have become too complex" to meet every other year is like telling your boss that you bought a new car and now need a raise to pay for it. Oregonians aren't asking you to create hundreds of new laws, beauracracies, agencies, commissions and the like. Keep it simple stupid.

His second argument is even funnier than the first. The "state agencies" (read Unions) and lobbyists have too much clout... with the legislative body that Courtney is a part of. They are lobbying YOU Peter. The only thing he really meant to complain about is the ballot-measure campaigns which is the will of Oregonians.

Tre Arrow is back
On June 8th, Tre was joyously greeted by friends in the Portland International Airport. For the first time in nearly seven years, he shared food, embraced, danced, laughed and sang with people outside of jail. An entourage of bicycles brought him out into the sunlight and traversed the 2.5 miles to the Oregon Halfway House. This was Tre's first bike ride since before incarceration in 2004. He entered the halfway house with fresh spring water, bare feet, a healthy tan and the love of his friends and family all around him.

The only stylish way to walk into a halfway house is barefoot. The rock star status that this guy has still amazes me.

Bill targets emissions from cars
A bill to help reduce greenhouse gas emissions from cars was hailed as a good first step during a public hearing in the Senate Environment and Natural Resources committee Tuesday.

House Bill 1059 would require Oregon Department of Transportation to develop a statewide strategy to reduce greenhouse gas emissions related to cars and to work with state agencies, transportation districts and cities to develop a practical guide to reduce emissions through land-use and transportation planning.

The sessions of the Legislative Assembly shall be held biennially at the Capitol of the State commencing on the second Monday of September, in the year eighteen hundred and fifty eight, and on the same day of every second year thereafter, unless a different day shall have been appointed by law.

The "emergency" has been used to get around this but what we clearly have is a violation of the principle. We do not have an emergency that requires our elites in Salem to dictate that land use (density) and transportation (don't build roads, build WES) force us out of our vehicles.

This session is unconstitutional and people should be yelling it from the rooftops.

M.E.Ch.A rallies for immigration reform
Earlier this month, the Portland State M.E.Ch.A chapter rallied outside U.S. Rep. David Wu’s office in an effort to garner support for both immigration reform and the DREAM Act. Marching alongside M.E.Ch.A were members of CAUSA, Oregon’s grassroots immigrant rights coalition.

“We believe that there needs to be a just and humane comprehensive immigration reform. The current laws that are in effect are tearing families apart and children are often caught in the middle,” said Orlando Lopez, Western Oregon University’s M.E.Ch.A liaison.

“M.E.Ch.A is more than a name—it is a spirit of unity, of sisterhood and brotherhood, and a resolve to undertake a struggle for liberation in a society where justice is but a word,” Lopez said.

You want amnesty for people in a country that you obviously despise. If "justice is but a word" in the United States what would you say that it is in Latin America?

M.E.Ch.A currently has 15 active members, although several other students are on its mailing list. The organization, according to Perez, urges all PSU students who are passionate about issues throughout the community to get involved.

The Portland State Tan Klan has 15 members. I guess the return of the Southwest to Mexico (where presumably justice is more than a word) isn't a very popular idea.

Backdoor taxes to hit middle class
The Obama administration's plan to cut more than $1 trillion from the deficit over the next decade relies heavily on so-called backdoor tax increases that will result in a bigger tax bill for middle-class families.

In the 2010 budget tabled by President Barack Obama on Monday, the White House wants to let billions of dollars in tax breaks expire by the end of the year -- effectively a tax hike by stealth.

If the provisions are allowed to expire on December 31, the top-tier personal income tax rate will rise to 39.6 percent from 35 percent. But lower-income families will pay more as well: the 25 percent tax bracket will revert back to 28 percent; the 28 percent bracket will increase to 31 percent; and the 33 percent bracket will increase to 36 percent. The special 10 percent bracket is eliminated.

I guess he's living up to the letter of his promise that you will not be taxed "one single dime" more... it's going to be a whole lot of dimes.

I would also note that position 2 on the board is open although the deadline for turning in an application has passed. These openings are opportunities to bring some common sense to our government schools and maybe a chance to keep racism off the reader board.

SALEM, Ore.—An Oregon appellate court has ruled that an illegal immigrant is ineligible for vocational assistance benefits.

In Carmen Carreon vs. Commerce & Industry Insurance Co., the claimant appealed a ruling by the director of Oregon's Department of Consumer and Business Services that denied her vocational assistance benefits for a 2005 injury that resulted in a permanent impairment award.

Way to go DCBS! A state agency actually used some common sense on this one. Follow this up with a court agreeing that "not allowed to work" actually means "not allowed to work" and I'm starting to have faith in Oregon government again.

When I think Carla, I think class

BlueOregon (paid) blogger Carla Axtman is one of those women who, if she is married, I feel sorry for her husband. But today her post attacking the Washington County GOP is really ironic because she sarcastically calls them classy.

This is the same women who had several posts in a row using the term "douchebag." Perhaps she thinks that "don't be a douchebag, vote democrat" will win the local electorate.

But I'm also very interested in this tidbit:

You are about gun control Carla, you want to restrict citizens ability to own firearms. Our government masters on the other hand are free to arm themselves as they please.

I'm sure that you support magazine capacity restrictions for citizens but not for people who work in government.

I'm sure that you would happily restrict citizens from being able to possess scary looking rifles but are just fine with law enforcement carrying those weapons. (as long as they pick and choose which laws to enforce, leave illegal aliens alone!)

Your typical "yes" voter may seem American on the surface but once you dig deeper you will find the following:

1. They negotiate with terrorists.
Threaten their children and they break faster than an Obama promise. The reason America has a policy against this is because it then becomes the preferred tactic of the terrorist and they will ALWAYS come back for more.

2. They vote with other people's wallets.
Votes no for a sales tax and general income tax but will vote yes for a cigarette tax increase (since they don't smoke) and a tax on the "rich" (since they aren't rich) and corporations (since they aren't corporations).For some this gives a misplaced feeling of generosity while others are simply lining their own wallets.

3. They are dependent.
When the typical yes voters grandfather or greatgrandfather looked at someone who was rich and successful they admired the person. They saw opportunity for themselves. When they looked at a corporation they had dreams of starting their own small business and turning it into the next General Motors Company.

This generation now is jealous of the bourgeois and merchant class. Rather than strive to be rich themselves they get more pleasure in tearing down the successful. Rather than earning and becoming independent they are satisfied holding their hands out for whatever scraps of health care, social security or housing that their government masters will dole out.

When politicians give speeches about protecting the "vulnerable" they proudly adopt that badge. "I'm vunerable so I matter" they think.

4. They are liars.
The only time you ever see a liberal be enthusiastic about keeping people in prison is when they are trying to raise taxes. Now that they have the money they can continue to feel sorry for criminals and doing everything in their power to release them as early as possible.

5. They work for government.
This voter is fighting for their very livelihood. They assume that their job is more important than yours because they work for the all-knowing, all-seeing and completely benevolent government. They have an entitlement attitude that rivals even the recipients of their handouts. If their paycheck is bigger, their benefits better and their workload smaller than the average Oregonian's then it's time to strike.

No sacrifice is too large for the taxpaying public to burden as long as these people are insulated from reality.

CAUSA seeks to return immigrant issues to forefront
Members of CAUSA, an immigrant-advocacy group with offices in downtown Salem, rallied last week outside the district offices of U.S. Rep. David Wu and U.S. Sen. Jeff Merkley in Portland.

Francisco Lopez, CAUSA's executive director, said immigration reform would help keep families together, bring employers and workers out of the shadows and ensure a more equitable tax system for everyone.

Marchers will be back at Merkley's office at noon Friday, Lopez said.

You know what else would "keep families together" and "bring people out of the shadows"? Not arresting anybody for anything.

Instead of feeling compassion for criminal aliens who break our laws we should feel contempt for parents who put their children in this position. What kind of person marries someone who could be deported at any moment? How do a couple arrive at the decision to have a child when they don't have a legal home here?

Illegal aliens know what the law is, they break it, they involve children and then expect us to feel sorry for them.

As for employers and workers who are in the shadows: let's turn on the light and watch them scurry away like the cockroaches they are. Letal workers and their ingenuity will step in to fill the market void.

I wish that someone had told me that the legislature had spent the last session creating new state agencies that would then need to hire Communities of Color Outreach Coordinators. Clearly we need new taxes to keep these new programs coming.

I can't imagine why the vote yes for Oregon campaign isn't running campaigns talking about not being able to create new state agencies such as this if the state doesn't take more money from the hardworking people of Oregon.

My only consolation if the taxes don't pass is that we can probably let a few inmates out of prison to make sure that this position gets funded.

I feel soooo sorry for people who work 8 months out of the year

I understand that there are a bunch of lefties and teachers who are planning to do the "door to door" canvasing tomorrow in favor of higher taxes. But wait, isn't tomorrow Monday? A work day? That's just for us peons, the teachers get that day off.

A bunch of people who get all summer off, a week in spring, two weeks for Christmas errrr "winter solstice" and every holiday known to man with the notable exception of St. Patrick's Day (democrats hate the Irish!!!) are complaining about a possible short school year.

As far as I'm concerned any minute that an innocent child isn't being told that recycling is the highest virtue known to man is a good minute.

Also I will repeat my position that we should close the taxpayer funded DVD rental stores that we call libraries and abolish the minimum wage.

How would these measures impact North Clackamas Schools?

For North Clackamas Schools, the funding impact this biennium would be $4.4 million for Measure 66 and $2.4 million for Measure 67. Because 83 percent of the district budget funds salaries and benefits, these areas would likely be impacted the most.

Together, these equate to the 2010-11 cost of either
• 16 school days; or

• 109 full-time teaching positions; or

• eliminating half of district telephones; all computer & software purchases, all textbook purchases, all library book purchases, 2.5 school days, 6 administrative positions, 28.5 classified positions, and 20 teaching positions.

Of course, these are just examples. No budget decisions have been made.


The thought of North Clackamas schools losing half of their telephones was just too much for me so I did a search of "north clackamas" on my own blog to get my own blast from the past wastes of money.


They sponsor "free" lunches during the summer at a local apartment complex. They don't have enough money to buy textbooks but they have money to go to where people live and give away food.


Their calendar from October 2008 listed an endless supply of "adult classes" in Spanish. I thought that we raised taxes "for the children."


North Clackamas is also home to the bilingual elementary school El Puente. 40% of the students in this school are "native spanish speakers."

These are some of the positions that will hopefully be eliminated when the taxes fail:

I know that eliminating the homeless liaison position or the Latino/Hispanic outreach program won't punish the voters enough so I'm sure that North Clackamas will instead fire a math teacher if they fire anyone at all.

The lawbreaker apologists went to Congressman Wu's office (ironically he is a "lawmaker") today to ask him whether he will sign on as a co-sponsor to the latest amnesty bill.

He told them he would decide by Friday. That gives us Thursday to let him hear from us. Tell him we don't want a culture of crime, we don't want to reward criminals, we don't want to make things worse for American workers and we don't want to encourage more illegal immigration!

For all these reasons, the City of Portland is on the verge of adopting a new plan for bicycling, the Portland Bicycle Plan for 2030.

A hearing before City Council to adopt the plan has been set for Thursday, February 4, 2010 at 2:00 p.m., time certain.

The hearing is a total show trial. On the Portland Transportation website they offer "Click here to express your support for the Portland Bicycle Plan for 2030!" which takes you to the "just click "yes!"" instructions.

They care about your opinion as long as your opinion is "yes."

Remeber, this is not just for your own good you fat lazy citizen who enjoys a heated and sheltered commute during the month of January, it's also to create equity with people who can't afford cars.

Earl Blumenauer is the first member of Oregon’s Congressional Delegation to sign on as a co-sponsor of the new amnesty bill. He's been on the government payroll for his entire adult life so it's no wonder that he supports moochers.

If you live in this guys district let him know that he won't be getting your vote in 2010. If he doesn't care about that then let him know that you plan on taking some unecessary car trips to punish the planet for his position.

The punishing battle over healthcare is still unresolved, but the Obama administration is quietly laying plans to take up another issue that could generate even more controversy and political division--a major overhaul of the nation's immigration system.

Already, senior White House aides have privately assured Latino activists that the president will back legislation in 2010 to provide a road to citizenship for the estimated 12 million undocumented workers now living in the United States.

Geoff Garin, a Democratic pollster, said the issue is difficult in virtually any environment.

"We know from a lot of experience that immigration reform has been and can be a very polarizing issue. There are heated differences about whether there ought to be some kind of pathway to citizenship for people who entered the country illegally," he said.

When the media calls an issue "divisive" or "controversial" they really mean that David Brooks' ruling elites like it, the rest of America hates it.

Amnesty is part of the ruin America trifecta along with health care and cap and trade. When you are calling, emailing, faxing or attending town hall meetings make sure that your representative knows that amnesty is a deal killer when it comes to getting your vote.

By not taking advantage of federal authorization to provide prenatal care to women who are undocumented or who have not met the five-year residency requirement, several thousand women and their infants lose the proven benefits of prenatal care;

Will there be changes to client caseloads or services provided to population groups?

There are approximately 6,000 births to CAWEM-only eligible women statewide per year, with an average growth rate of 5.5% per year. Labor and delivery care is already supported by state General Funds and federal matching funds.

There will be additional women served in the Citizen-Alien Waivered Emergency Medical (CAWEM)program. This POP will add an average of 68 women per month for 24 months for the 2009-11 biennium. In 2011-13 there will be an average caseload increase of an additional 141 women per month.

It goes on and on. Did you have any idea that Multnomah and Deschutes counties had already sanctioned giving illegal aliens extra health care? Now the beauracrats at DHS may decide or have already decided to take this statewide with no public debate or knowledge.

Your general fund tax dollars, your federal tax dollars, even your "soft" tax dollars are helping illegal aliens.

Oil-rich Venezuela ushered in 2010 with new measures rationing electricity use in malls, businesses and billboards, as Hugo Chavez's government aimed to save power amid a crippling drought.

A decree published on Christmas Eve states that commercial centers may operate from 11:00 am to 9:00 pm on the electricity grid, but beyond that establishments would have to operate off-grid, using their own generators.

When a country refuses to use it's natural resources then the citizens suffer. It would be like Oregon refusing to... allow... logging...

Walmart, others make money on Oregon's energy tax credits
When Oregon started handing out jumbo tax subsidies for renewable energy projects two years ago, one of the biggest beneficiaries was also one of the world's richest corporations -- Walmart.

No, the retail giant hasn't branched to solar panels or wind turbines.

Instead, Walmart took advantage of a provision in Oregon's Business Energy Tax Credit that allows third parties with no ties to the green power industry to buy the credits at a discount and reduce their state income tax bills.

State records show Walmart paid $22.6 million in cash last year for the right to claim $33.6 million in energy tax credits. The cash went to seven projects, including two eastern Oregon wind farms and SolarWorld's manufacturing plant in Hillsboro. In return, Walmart profits $11 million on the deal because that's the difference between what it paid for the tax credit and the amount of its tax reduction.

This kind of accounting is the future of cap and trade. As much as liberals would like to eliminate free markets this kind of trading is the logical outcome of these silly social engineering policies.

The irony is that long before being "green" was trendy saving energy was something that people did because of self-interest. Who didn't grow up with a parent who remarked that "they weren't paying to heat the whole neighborhood" when you left the front door open in the winter?

Lawmakers and enviro-nuts act as if people wake up in the morning thinking of ways to burn fuel without getting any benefit for it and that if they just offer "free money" then energy consumption that would have happened will not and this will have no consequences.

I was installing a new garbage disposal yesterday and on the outside of the box it mentioned that the warranty gave you certain "legal rights" but that your "rights" may vary depending on which state you live in.

That means that either states can either grant and withold "rights" or that these are not rights at all but they are simply laws.

During this debate we should all remember where our rights come from: God. They are human rights that we believe to be self-evident and our founding documents tell government that they can't infringe upon them.

Congress may pass a law regarding health care but that won't give you a right to it since a future congress can simply take it away again.

It's almost the end of the year which means time is running out to use your political tax credit.

The Political Tax Credit allows a married couple to contribute up to $100 -- a single person can contribute up to $50 -- to a qualified political cause and receive the full amount of their contribution back as a credit on their Oregon tax return.

Please note, this is not a tax deduction like your home mortgage interest deduction or contributions to a charity. This is a dollar-for-dollar credit. In other words if your total state taxes for 2004 were $500 and you made a political contribution to a qualified political committee of $100, you would only pay $400 in taxes.

Ensign, DeMint to Force Vote on Health Care Bill Unconstitutionality
Today, U.S. Senators Jim DeMint (R-South Carolina) and John Ensign (R-Nevada), raised a Constitutional Point of Order on the Senate floor against the Democrat health care takeover bill on behalf of the Steering Committee, a caucus of conservative senators. The Senate will vote tomorrow on the bill’s constitutionality.

“Forcing every American to purchase a product is absolutely inconsistent with our Constitution and the freedoms our Founding Fathers hoped to protect,” said Senator DeMint. “This is not at all like car insurance, you can choose not to drive but Americans will have no choice whether to buy government-approved insurance. This is nothing more than a bailout and takeover of insurance companies. We’re forcing Americans to buy insurance under penalty of law and then Washington bureaucrats will then dictate what these companies can sell to Americans. This is not liberty, it is tyranny of good intentions by elites in Washington who think they can plan our lives better than we can.”

Americans who fail to buy health insurance, according to the Democrats’ bill, would be subject to financial penalties. The senators believe the bill is unconstitutional because the insurance mandate is not authorized by any of the limited enumerated powers granted to the federal government. The individual mandate also likely violates the “takings” clause of the 5th Amendment.

I heard something on the radio today that should become our refrain: We will not consent to be governed. I'm not sure what that looks like right now but our government was created to SECURE our existing rights, not to create new ones.

There were suggestions as to ways to withold our consent called in to the talk show, I'm curious if anyone has any constructive ideas here.

Less Health Care for More Money
The New York Times' Nicholas Kristof recently wrote a column about John Brodniak of Oregon, who developed a cavernous hemangioma, causing him great pain as blood leaks into his brain.

According to Kristof, Brodniak can't get medical help because we don't have universal health care. Senators who vote against ObamaCare, Kristof said, are morally equivalent to someone who would walk past a man "writhing in pain on the sidewalk."

In another article in the Times, William Yardley wrote about Melvin Tsosies -- also of Oregon -- who ended up with $200,000 in medical bills after having a heart attack.

As of March 2008, Yardley reported, Tsosies was waiting to find out if he would win the Oregon lottery for health insurance. But with 600,000 uninsured state residents and a "universal" health care program with only enough money to pay for about 24,000 of them, Tsosies is more likely to win a Powerball lottery.

How can this be happening? Oregon already has "universal health care"! (Probably just a coincidence, but isn't Oregon also the only state with physician-assisted suicide?)

Once again forgetting about the existence of the Internet, the Times neglects to mention its own erstwhile enthusiasm for Oregon's universal health care plan, introduced back in 1990.

How do you spell irony: O-B-A-M-A

Did anyone else find it just a little amusing that yesterday Obama held a press conference at Home Depot, a place notorious for allowing day labor pick-up sites in their parking lot, to discuss jobs in the contruction industry, a field notorious for hiring illegal aliens, as he described putting "millions" of Americans back to work?

Can't we just dig our way out?

Time for an Immigration Moratorium
When Barack Obama completely ignored the problem of uncontrolled immigration during his Jobs Summit, my former colleague Rep. Lamar Smith (R-Texas) issued the following statement that was signed by 21 conservative Republican congressmen:

“With a 10 percent unemployment rate, now is the time for the Obama administration to stand up for citizens and legal immigrant workers. Now is the time for the President to enforce immigration laws. When the jobs stolen by illegal immigrants are recovered for citizens and legal workers, American workers will benefit. President Obama could create eight million jobs for citizens and legal workers simply by enforcing immigration laws.”

I applaud Rep. Smith for standing up against illegal immigration, but we need to go a step further to protect displaced American workers. The first priority of our government needs to be the interests of American citizens -- both native born and naturalized -- not “legal immigrant workers.” And the 25 million American citizens out of work are not only pushed out by illegal aliens, but also by certain legal immigrants.

Even if we completely stopped illegal immigration tomorrow, the government still issues 75,000 permanent work visas and approximately 50,000 temporary work visas every month. These 125,000 jobs should go to Americans first.

Much like the teacher's union not being able to say how much is "enough" per pupil funding the advocates of unfettered immigrantion will never give the "enough" amount of people that we should allow into the United States.

Their secret answer is "how much can we get away with?" In addition to keeping jobs for America citizens at some point we need to keep our American identity. With rapid and uncontrolled immigration we don't give new people a chance to assimilate.

Households take up challenge to be chilly
In Laura Nichols' Maplewood, N.J., home, Poochie the dachshund is a hot commodity.

Nichols and her four teenage children vie for the use of the 30-pound dog as an overnight leg warmer to stave off the 50-degree chill in their home.

Once again, Nichols has entered a local Internet message board's "furnace abstinence" contest where bragging rights and an iceberg-shaped trophy are at stake for those who can go the longest without turning on their furnaces.

Run on an honor system, some challenges, such as the one in Maplewood, dare households to go cold turkey for as long as possible. Using space heaters and fireplaces is allowed.

The reward is knowing that participation in the challenge means helping the environment and saving on heating costs, Duke says.

This trend of "let's suffer for the planet" would be funny if there weren't people in government who believe that putting sterilants in drinking water might be necessary to lower the population.

Saving money on YOUR heating bill is a great idea if you so choose but don't use the power of government to turn down MY furnace.

Senators blast Oregon for stimulus waste projects
On December 8th, U.S. Senator Tom Coburn and Senator John McCain released their Stimulus Checkup Report. The report lists 100 projects as part of the $700 billion stimulus program targeted as waste. Four Oregon projects made the list are listed below:

Recovering Crab Pots Lost At Sea ($700,000)

Renovations for Federal Building as Expensive as New Building ($133 million)
The money will go toward greening the Edith Green/Wendell Wyatt Federal Building in the hope of making it a model for energy efficient government offices in the Northwest

Removing Lead Paint from a Pedestrian Bridge ($3.5 million)

Wastewater Treatment Center with “Talking Water Gardens” ($8 million)
In order to spend the money as fast as possible, the city of Albany will issue a non-competitive contract for work on the project. According to the city‘s planning document, the waterfall component is expected to have an important acoustical impact that is the driver for the name "Talking Water Gardens." Local residents will also be facing an increase in sewer rates to pay for the new water treatment system.

At least one talking water garden saved or created! Who else can't wait to see what we get with Stimulus 3?

Oregon state employee compensation

Oregon public employees are being paid more to work fewer hours according to calculations by the Oregon Department of Administrative Services.

Oregon has tens of thousands of state employees. Over the past several months, the news media has stated that these “dedicated” Oregon public servants are experiencing budgetary cuts that will result in lower pay and reduced hours. They suggest that the budgetary cuts must in turn reduce services to the public. As a member of both the Ways and Means Committee and the Emergency Board, I have first hand information regarding the cost of employee salaries and benefits. That knowledge leads me to question the accuracy of some of the news releases.

According to the DAS figures, in 2008 the average state employee was paid $47,724 in salary and $20,407 in benefits for a total compensation of $68,131. In 2009 the average state employee will be paid $48,459 in salary and $20,569 in benefits for a total of $69,028. The $897 increase in average compensation is after an average of $2,682 was subtracted for mandatory time off without pay called furlough days.

I am not sure how I made it through an entire day without a MULTI-CULTURAL EDUCATION TECHNICIAN ($3208 - $4476 MONTHLY).

Oregon mulls native language diploma
Some Oregon high school students who possess only intermediate English skills but read and write well in their native language will be able to qualify for a diploma using those native language skills.

The Oregon Board of Education voted for the policy, which state officials estimate could apply to 300 to 400 high school seniors out of about 36,000 who graduate each year.

Oregon's new diploma will be just like Oregon's old drivers license: made easy for illegal aliens.

A child who is born here in America will be held to a higher standard for graduation than an illegal alien. And the legitimate students who can legally get a job after high school are set up for failure since they aren't taught the necessary skills to communicate verbally and on paper.

If the schools are failing with their current method of teaching ESL and "native language classes" perhaps they should try English immersion. Of course, if the schools are satisfied with lowering standards and setting kids up for failure then by all means, keep up the good work.
