Constitution? What's that?

Ensign, DeMint to Force Vote on Health Care Bill Unconstitutionality
Today, U.S. Senators Jim DeMint (R-South Carolina) and John Ensign (R-Nevada), raised a Constitutional Point of Order on the Senate floor against the Democrat health care takeover bill on behalf of the Steering Committee, a caucus of conservative senators. The Senate will vote tomorrow on the bill’s constitutionality.

“Forcing every American to purchase a product is absolutely inconsistent with our Constitution and the freedoms our Founding Fathers hoped to protect,” said Senator DeMint. “This is not at all like car insurance, you can choose not to drive but Americans will have no choice whether to buy government-approved insurance. This is nothing more than a bailout and takeover of insurance companies. We’re forcing Americans to buy insurance under penalty of law and then Washington bureaucrats will then dictate what these companies can sell to Americans. This is not liberty, it is tyranny of good intentions by elites in Washington who think they can plan our lives better than we can.”

Americans who fail to buy health insurance, according to the Democrats’ bill, would be subject to financial penalties. The senators believe the bill is unconstitutional because the insurance mandate is not authorized by any of the limited enumerated powers granted to the federal government. The individual mandate also likely violates the “takings” clause of the 5th Amendment.

I heard something on the radio today that should become our refrain: We will not consent to be governed. I'm not sure what that looks like right now but our government was created to SECURE our existing rights, not to create new ones.

There were suggestions as to ways to withold our consent called in to the talk show, I'm curious if anyone has any constructive ideas here.

You know here's a thought -- how are people who are homeless or people like me who are having a very hard time finding any type of work and are in the process of declaring bankruptcy going to pay for a mandatory healthcare system?

In fact, that little tax refund that I'm counting on to hopefully at least pay my car insurance will not be there if I have to pay a $2000 penalty on my taxes for health insurance

We pay enough taxes into the system that we can afford to provide healthcare for all be US citizens. If they wish to do it that way, I am all in favor of it. And don't tell me that we can't afford it either. Hillary Clinton just offered billions of dollars to third world countries in order to help them reduce greenhouse gases. Like I've always said, "right pocket, left pocket, it is all the same pair of pants."

Speaking of healthcare... one of the reasons besides the unemployment (which I'm not eligible for unemployment insurance by the way) that I am declaring bankruptcy is because of a recent emergency trip to the hospital and surgery which sent me over the edge financially.

Were fighting to keep our home and in survival mode right now, and the last thing, the very last thing that we need right now is more taxes and expenses.

They would fear this! Time for a 28th Amendment.

Amendment 28

Congress shall make no law that applies to the citizens of the United States that does not apply equally to the Senators or Representatives, and Congress shall make no law that applies to the Senators or Representatives that does not apply equally to the citizens of the United States.

Let's get this passed around, folks - these people have brought this upon themselves!!!

Well, it's done.

It is not improbable that some of the people who read this blog, and nod along obliviously, have at least one person in their family who is going to find themselves critically ill or injured in the coming years. Someone who will, as an ultimate result of the vote this morning, receive quality health care, with less red tape and greater confidence that their doctors and medical professionals are able and willing to help them. Someone who, in short, will not be sick, crippled or dead, but instead alive and spending many years with the people they love, such as you, thanks to this reform.

I fervently hope that this is true, regardless of whether you realize or acknowledge it.

Hello, this quality health care bill is not scheduled to even go into effect until 2014. 4 years from now. There will not be one person saved this coming year because of this poor legislation. Not one. In fact, taxes will go up and you will get nothing for it. Nothing for at least 4 years, that is if it survives the constitutional challenges it is going to face. There is this small matter of that pesky 10th amendment and all, that could get a little tricky.

kaelri, I'm not sure if you have paid attention to the countries and Massachusetts who have similar health care, they are going broke and rationing health care. We have the best health care in the world, why would you want to change it completely instead of fine tuning it? Don't fix something that isn't broken. I'm in the repair business.

I'm not sure if understand those implications. This means that when our family member finds themselves critically ill or injured in the coming years, they will die earlier or have a more miserable remaining live.

Do you seriously think that government run health care will decrease red tape, increase quality and increase confidence that their doctors and medical professionals are able and willing to help them? My sister is one of those medical professionals. I think you need to talk to some of the doctors and medical professionals. My sister works eighty hours a week, pays a shit load of taxes (I bet more than you make in a year) and makes medical devices which are going to be taxed. They will lay people off or close up business. She is in the business of saving lives, people will die sooner because of the messiah's health care. When has a government increased quality and decreased red tape? I'm a veteran, I know about the quality and red tape. I have family and friends that have worked for governments. Keep up your fantasies, they may be all you have in the future. You are very confused and need to see the light. My girlfriend's stepfather is from England, he's not a fan of England's health care, neither is his sister who is living here now.

Keep up the fantasies, I hope my family or friends do not die from this evil health care crap. I hope it is people who wanted it.

If this health care is so wonderful, why is congress not taking advantage of it? As always, be careful what you wish for. You may be in for a rude awakening.
