By Mark Cromer - Dr. Gene Rogers had a pretty good idea of what was coming when he saw his supervisor and a county security officer arrive at his office door. His supervisor was holding paperwork; the security guard was holding an empty box.

Dr. Gene Rogers knew what they had come to do, and why they were doing it. As the medical director for Sacramento County's Indigent Services program for the better part of the past decade, Dr. Rogers has waged a long fight against the central California county's practice of providing non-emergency medical care to illegal immigrants — a policy he says violates federal law and results in the poorest American citizens being denied the care they deserve.

That fight cost Dr. Rogers his job. In a two-sentence memo to Dr. Rogers, the county's Health and Human Services director, Lynn Frank, informed him that he was fired, but thanked him for his services. No reason for his termination was offered, but then he didn't really expect one. "Sacramento County knowingly violated state and federal laws, misappropriated taxpayer revenues and diverted funds designated for indigent citizens to pay for services delivered to illegal aliens," Dr. Rogers said. "And they did so even as they cut the budget."

Fired earlier this month, Dr. Rogers is the latest casualty on a frontline in the struggle over illegal immigration that's often overshadowed: the battle that has simmered throughout government agencies. Many government employees remain silent in the face of what's happening — fearful for their jobs and perhaps doubtful that they would make a difference. But Dr. Rogers, a Vietnam veteran, felt compelled to become a conscientious objector to the status quo.

The local cost of the medical treatment provided to illegal immigrants is small when contrasted to the billions of dollars the state and federal governments spend every year on the "undocumented," but the numbers have grown dramatically. According to county health officials, the hundreds of illegal immigrants who were being treated through the indigent program in the mid-1990s have now grown to thousands of people, with the annual cost to taxpayers swelling into the millions of dollars.

Ironically, when Dr. Rogers, 67, took the position of medical director for the indigent services program back in 1999, he arrived in the Central Valley with hardly a clue (let alone an opinion) about illegal immigration and its impact on social services. He had one goal: to provide the best care possible for those who need it most.

As the years went by, however, that egalitarian perspective began to be tinged with cynicism as he watched poor citizens get squeezed out of the system even as illegal immigrants gleefully manipulated it, all while bureaucrats facilitated the rampant violations of the very laws they were entrusted to enforce.

"I've seen cases and case histories of patients who essentially have come up from Mexico for the express purpose of being treated here, and then leaving to return home," Dr. Rogers said. "I've watched illegal immigrants brazenly demand free, non-emergency health care that was meant for our poorest citizens. I've heard them and their families complain. They feel entitled to it." Dr. Rogers filed a lawsuit in 2003 after county officials "stonewalled" him when he questioned why they were cutting budgets while still providing non-emergency medical treatment to people who have no legal right to be in the country.

The lawsuit is currently under appeal in federal court, but its impact was felt in the state capital, causing a nervous Latino Legislative Caucus in California last year to push through a bill by state Sen. Deborah Ortiz that explicitly allows counties to "opt" to provide non-emergency medical care to illegal immigrants. Sacramento County also responded, Dr. Rogers said, by seeking to alienate him from his prior relationships with county medical staff and by methodically preparing to fire him — with a little humiliation thrown in along the way. On one occasion, Dr. Rogers said, he was forced to sit through a staff meeting in which his supervisors asked case-management nurses one by one if they had any issues or problems with him. None said they did, but it was a humiliating experience.

"I am concerned that you continue to focus on patients' immigration status," Program Manager Nancy Gilberti said in a negative work review, "which is outside your and [the] program's purview." Mrs. Gilberti's remarks reflect a prevailing culture that has emerged in government: a culture that will not tolerate anyone who dares to draw a distinction between American citizens and illegal immigrants. It is a culture that now pervades police departments, public schools and universities, social services and health care.

But when someone like Dr. Rogers speaks up to question the impact on citizens of such allocation of funds for health services like those in Sacramento, the response is clear: Sit down and shut up — or else.

But considering that a young Dr. Rogers started his medical career trying to save the lives of horrifically wounded American soldiers in the jungles of Vietnam, Sacramento County's apparatchiks picked the wrong target this time. For Gene Rogers himself, his crusade is deeply rooted in those grim battlefields he found himself on more than 30 years ago. He watched young men fight and die, men who sacrificed all for the very distinction that citizenship brings to Americans.

It's a distinction that Sacramento County and so many others may choose to ignore, but for Dr. Rogers, that loyalty is a sacred trust he is determined to keep.

LAWRENCEVILLE, Ga. (AP) - Officials started taking steps to deport a Mexican teenager who was jailed after refusing treatment for tuberculosis.

Francisco Santos, 17, has acknowledged to U.S. Immigration and Customs Enforcement agents that he is in the country illegally, Gwinnett County Sheriff Butch Conway said Wednesday.

County health officials jailed Santos last week after he refused treatment for an active, contagious case of tuberculosis and threatened to travel to Mexico, a move that could expose more people to the potentially fatal disease. Santos, who lives in Duluth, has since started taking medicine, but he will remain jailed at least until a Sept. 5 hearing.

Conway said Santos' condition and age could further complicate a deportation process that can take months. Because he is a minor, officials would have to make sure he has family in Mexico or that the Mexican government would take a role.

Four people who had been living with Santos have also tested positive for tuberculosis, health officials said Wednesday.

"Those four tested positive but are not actively ill," Gwinnett County Health Department spokesman Vernon Goins said. "Chest X-rays were negative, and we will treat them to keep the disease from developing."

Goins said the four are not contagious and will follow the typical TB treatment for nine months. Four other relatives have tested negative, five more came in for testing Wednesday, with results expected Friday, and three more people will be tested Monday, officials said.

The incident in some ways echoed the case of Andrew Speaker, the Atlanta attorney who in May was held under a federal isolation order after he went on a European wedding trip and refused health officials' directives that he not take any commercial jets back to the United States.

Tuberculosis kills nearly 2 million people each year worldwide.

Because of antibiotics and other measures, the TB rate in the United States has been falling for years. Last year, it hit an all-time low of 13,767 cases, or about 4.6 cases per 100,000 Americans.

I'm going to attend EVERY school board meething possible to complain about this shit. Ridiculous the amount I pay in taxes, and the "free" meals and school supplies go to people who aren't even in the country legally. Meanwhile, the school is begging parents to provide teacher and classroom supplies like kleenex, art supplies, etc.. Absolute bullshit. I'm putting my kid into private school next year.

EMAIL FROM JANET CARLSON REGARDING 287G

Thank you for your recent correspondence regarding illegal immigration, the role of local law enforcement, and Section 287 (g) of the 1996 Immigration and Nationality Act.

Oregon Revised Statute 181.850 specifically prohibits law enforcement agencies in the State of Oregon from spending agency moneys, equipment or personnel "for the purpose of detecting or apprehending persons whose only violation of law is that they are persons of foreign citizenship present in the United States in violation of federal immigration laws." However, the same statute does allow law enforcement agencies to exchange information with United States agencies involved with immigration, customs enforcement, and border protection.

An opinion rendered by Attorney General James A. Redden in April 1977 that is still in force today states that, in light of ORS 181.850 and case law, "a state or local law enforcement officer may only stop and detain a suspected alien if the officer has independent reason to do so for possible violation of state law or local ordinance."


The opinion goes on to clarify that, "We do not mean to say, however, that state and local law enforcement officers may not cooperate with federal agents in the enforcement of United States Immigration and Naturalization laws. Assistance by Oregon officers in the investigation of, surveillance of, and even arrest of illegal aliens is within the discretion of policy authorities, as long as the federal agents initiate the activity, request assistance, and as long as all interrogations and arrests are at their direction. ... We believe the officer should treat each situation exactly as he normally would where the person is not an illegal alien: where he has probably cause to arrest and incarcerate a person for violation of a state offense, he may do so and thereafter notify federal agents that he believes the person is an illegal alien."

An additional clarification follows: "In the case of an alien, a full arrest for relatively minor offenses may be reasonable because the alien -- knowing he has been discovered and may face deportation -- will be less likely than other persons to appear for trial."

I have discussed this issue with a member of Marion County’s legislative delegation. She is interested in pursuing a review of the existing Oregon legislation. I am also committed to promote ongoing communication between the Marion County Sheriff's Office and the federal Immigration and Customs Enforcement (ICE) in determining the immigration status of individuals who have been arrested and lodged in the Marion County jail for various crimes, to the fullest extent allowed under federal and state law.

Of the 1.7 million tax returns processed so far, only 13,427 have checked the box that donates the amount of their kicker check to schools. This amounts to 0.8% or one out of 125 tax returns. Come on friends, after all it's for the kids.

What’s the old adage, “Don’t talk about religion or politics, if you want to stay friends”?
Unfortunately, the problem is we don’t talk about politics, deeply held beliefs, values, ethics and principles enough. Otherwise, we’d be solving some of the most challenging political issues in front of us.

Right now in Oregon we have a crime problem that people are afraid to discuss: Crimes committed by illegal aliens. We all have friends (or even family members as I do) who are Hispanic, Russian, Asian, Cuban or some other nationality and the last thing anyone wants to do is offend our friends or family. Not everyone who lives in the United States or Oregon is an American citizen. Citizens of other countries choose not to become Americans for a variety of reasons.

This discussion is not about law-abiding citizens or about foreign nationals here on visas or green cards, or student visas, or exchange students. The discussion is about protecting our citizens from crimes committed by people who are in American illegally. Heinous crimes such as the recent murder of the 15-year old girl in Milwaukie, auto-related deaths on our highways, and repeated drug-use related crimes exacerbate the problem. It is time to do something about it.

Marion County Commissioners will be appointing a new sheriff in the next few weeks and local public safety advocates believe the new sheriff has a responsibility to take a stand on criminal aliens. They believe local police agencies can and should do more to work with the federal government to remove these criminals from our community and they want Marion County Commissioners to make this one of the criteria as we appoint a new sheriff.

I agree. Public safety is government’s primary responsibility. Anything we can do to better protect our citizens from criminal activity, should be done.

Citizens are asking that Marion County cooperate with the federal government and participate in what is known as the 287(g) program. However, we’ve been advised that Oregon state law prohibits us from participating in this federal program! In order to find out how we can participate in 287(g), we have begun discussions, research and debate, all of which have resulted in stacks of background materials and conflicting viewpoints.

It’s all very frustrating to be told that our state law conflicts with federal law, prohibiting us from utilizing effective tools to provide improved public safety. And, it’s confusing when I think of the oath of office I took as an elected official. The oath all elected officials take, including the sheriff. We swear to support the constitution and the laws thereof of both The United States of America and the State of Oregon.

So, you can see the dilemma we face! There is agreement that Marion County can and should step up to do more to protect our communities from criminal activity, but we find ourselves in the midst of a legal quagmire!!
The 287(g) program is in effect in California, Arizona, North Carolina, Florida, Georgia, Tennessee and Alabama. More than 60 municipal, county, and state agencies nationwide have requested 287(g) Memorandums of Agreement and more than 400 local and state officers have been trained under the program, according to the Immigration and Customs Enforcement (ICE) website. The program cross-designates local officers to enforce immigration law. ICE provides the necessary training, and supervises all the cross-designated officers when exercising their immigration authorities.

In addition to removing criminal aliens from our communities before they commit additional crimes, communities are embracing 287(g) as saving taxpayers substantial money. Removing criminal illegal aliens from our jail allows local law enforcement to better use scarce jail beds.

Marion County citizens have brought this issue to our attention and they’ve requested our help in fighting crime; just as community members brought to us the problems associated with meth and requested our help in that fight. Working together we have made a positive impact against meth in our neighborhoods. We’ve reduced the number of meth labs throughout Marion County, we’ve targeted property crimes related to meth use, we’ve rescued hundreds of children from meth-infested households, and we raised awareness about ID theft. Now it’s time to do what we need to do to reduce crimes committed by illegal aliens.

The only time the pro-illegals trot out the old canard that the federal government is solely responsible for anything is when it comes to dealing with the illegal alien problem. They are fine when local officials overstep their authority and pass measures to legalize gay marriage or pull troops out of Iraq.
It is encouraging to see that some local officials actually get the connection between support for unlimited lawlessness and a lot of the problems we face today. There may be hope yet.

The Sherwood school board recently voted to spend $26,000 to hire a consulting firm to coordinate their new "vision 2020" effort.

First imagine the vision.

Then imagine what $26K would do for all the fund raisers trying to scrape up a few bucks. 10 fundraisers could use $2600.00 each far more than another assinine visioning process to show "leaders" how to do their job.
