So I was in the ER this afternoon...

In honor of our new Supreme Court nominee I've been thinking that we should honor her policy of racism but apply it to more than just firefighters and their tests. Some possible areas of concern:

Heart surgeons. Rather than hire and promote the best doctor to operate on you we should decide who cuts you open based on racial fairness.

Proffesional athletes. Who really cares about touchdowns, slam dunks and strikes. What really matters is that a team has the exact racial makeup of the city they are in.

Firefighters. I know, it's been done. But think about it, imagine yourself in that burning building or medical situation, could you really live with yourself knowing that you were saved by a firefighter who passed a test proving that they were qualified?

In that decision, he did what your previous post stated you wanted her to do. She followed precedent. Since judges aren't supposed to "make the law" but rather "follow it" what do you propose she should have done in that case? Further, she didn't write the opinion.

Seems you and your pals like to honor "policies of racism", but in this matter your own ignorance misleads you.

With regard to the Firefighter case, Sotomayor was on a three judge panel that unanimously ruled the city was within its right to throw out results of a promotional exam because too few minorities scored high enough. The decision relied on precedent, not on judicial activism.

No, she said they made "policy" in the courtroom. You all have nothing to worry about: though a social moderate, she has ruled time and time again in favor of corporate interests. Carry on.

You see Daniel, this is exactly why people like you are - politically speaking - going the way of the dinosaurs. By disingenuously claiming that Sotomayor's body of jurisprudence adds up to a "policy of racism", you're just providing more fodder and evidence as to why people of your political ilk are unfit to lead, or to hold any positions of power much greater than city dog catcher.

As has already been pointed out to you, the case you refer to (which is still an active case, btw) was adjudicated by two other judges, who happened to hold the same opinion as Sotomayor. Moreover, that opinion followed precedent...something you pseudo-conservatives claim (at least when it's convenient) that you want judges to follow.

Which all gets back to a point I made yesterday. Your biggest beef with Sotomayor, is simply that she's an Obama Supreme Court nominee. Obama could have nominated a ham sandwich, and you'd still be bitching about it simply because it was an Obama nominee. Deny it if you want. I'm pretty certain even you know it's true.

And as far as ethnicity playing a role in Supreme Court nominees goes, something tells me you probably weren't so upset when a previous nominee to the court said the following:

"Because when a case comes before me involving, let's say, someone who is an immigrant -- and we get an awful lot of immigration cases and naturalization cases -- I can't help but think of my own ancestors, because it wasn't that long ago when they were in that position. ...But when I look at those cases, I have to say to myself, and I do say to myself, 'You know, this could be your grandfather, this could be your grandmother. They were not citizens at one time, and they were people who came to this country.' ...  When I get a case about discrimination, I have to think about people in my own family who suffered discrimination because of their ethnic background or because of religion or because of gender. And I do take that into account."

Those words were uttered by conservative Supreme Court Justice Samuel Alito.

But keep at it. "Conservatives" seem to have perfected the art of self-destruction recently, and they seem all too willing to showcase it with this Sotomayor nomination. In a way, this is a good thing.

The Court case was on Lou Dobbs on CNN and involves White people and one Latino, who were NOT promoted because the Black people did not pass the important Test.

Sooooo, just like in our Schools, do we Dumb down the Test and have incompetents working there in such an important Life saving job? Or do we let more people DIE for the sake of being PC?!

Hey we are now in Oregon going to do that with Sports Coaches too.

All the White people that Founded, Built and Defended this Nation for the last several Centuries have every right to complain and is isn't "Racism" to do so!

Yes, sometimes on the backs of Slaves from Africa or Today Endentured Servants from Mexico, Both actions are inhumane, but the Farmers/Biz owners want increases even.

Folks, the people of ROME had running water over 2,000 years ago. Yet over 1/2 the people in Mexico & Africa still do NOT.

Yet now you get paid more IF you speak the language of that Failed Nation/Culture?

So now we have a Pres. (only because he's 1/2 Black) who couldn't profitably manage a HotDog stand (only Minorities get a free lunch) and he wants a Dumb, Racist, Hispanic & Female on the Supreme Court? Well of course!

Stevie- please stop with the ham sandwich example. We get it, anyone Obama nominates will be opposed by conservatives, but a ham sandwich, what about our kosher population and our Muslims?
Just because she belongs to La Raza, which continues to link with MeChA which I consider to be racists, doesn't necessarily mean that she is racist, it is a warning flag. And her comments about white judges just adds to that concern. I know because I am continuously called racist because I side with the Minute Men and other closed border advocates.

Daniel, I heard Lars yesterday talking to some idiot about this. The hearts surgean scenario jumped into my head. Did that idiot want the best surgeon working on him or someone who was placed there because of a racial quota. I think if his life was hanging in balance, he would change his mind and want the best surgeon. I don't think he would care about color or race or whatever.

You say conservatives have perfected the art of self-destruction. Well, the messiah and his minions have perfected the art of destroying America. This will be great for conservatives. I'm hoping there will be a landslide in the next elections. It took years for the republicans to become corrupt, it took weeks for the dems to start looting the store and stealing from our grand children. I just hate that the country will sustain so much damage. Our great grand children buried with huge debt. High unemployment. Higher taxes with wealthy people moving their money out of the country. I don't think there will be much left of the Constitution. In several years we will look like venezuela or more likely mexico. Obama and his minions make Stalin look like a candy store robber.

I have not heard this angle discussed anywhere else, but if she had ruled with the fireman would she have not done the same thing that the judges are doing with gay 'marriage'? The courts are ruling that the state laws are unconstitutional and therefore gay marriage is OK.

Seems to me that either they were discriminated or they were not. I guess that is what the Supreme Court will decide.
